Law Enforcement Requests

How we respond to legal requests for customer information. Short answer: valid Canadian court order, or nothing.

Our position

FibreTel will only disclose customer information when legally compelled to do so by a valid Canadian court order, warrant, or subpoena. We do not voluntarily turn over customer data, even when asked politely.

Who we accept requests from

  • Canadian federal, provincial, and municipal law enforcement agencies acting under proper legal authority
  • Canadian courts, tribunals, and regulatory bodies with jurisdiction over the subject matter
  • Foreign law enforcement only through Canadian mutual legal assistance treaties (MLATs), not direct requests

What we require

Every request must include at minimum:

  • A certified copy of the court order, warrant, or subpoena
  • Identification of the requesting officer and their agency
  • A specific account, phone number, IP address, or time range — we do not respond to fishing expeditions
  • A legitimate domain email address for the requesting agency (we verify the sender)

What we refuse

  • Informal requests (phone calls, emails without documentation)
  • Requests from non-Canadian jurisdictions that don’t go through MLAT
  • Requests from private parties (rights holders, civil litigants) — those require a court order specifically authorizing disclosure, not a demand letter
  • Emergency disclosures without documented life-threatening circumstances and supervisor verification

Emergency disclosures

In exigent circumstances where there’s a credible threat to life, we may disclose limited information before receiving the formal order, provided the requesting officer signs a written attestation and follows up with proper documentation within 48 hours. This exception is narrow by design.

Customer notice

Where legally permissible, we notify affected customers before disclosing their information so they can object. We do not notify when the order explicitly prohibits notice (e.g. production order under gag).

Transparency reporting

We intend to publish an annual transparency report documenting the number of requests received, the number fulfilled, and the number denied. First report: pending — will post here when ready.
