Terms of Service

Welcome to FibreTel! We’re thrilled to have you join our network.

Please read these Terms of Service (“Terms”, “Terms of Service”) carefully before using FibreTel’s internet, phone, or  television services (the “Service”) operated by FibreTel Networks Ltd. (“FibreTel”, “us”, “we”, or “our”).

1. Acceptance of Terms
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

2. Description of Service
FibreTel provides high-speed internet access through our fiber optic network. The Service includes internet connectivity, television, phone, technical support, and related services.

3. Use of Service
You agree to use the Service only for lawful purposes and in accordance with these Terms and our Acceptable Use Policy. You are responsible for maintaining the security of your account and any content transmitted through the Service.

4. Acceptable Use Policy
You agree to follow FibreTel’s Acceptable Use Policy while using the Service. The Acceptable Use Policy outlines guidelines for acceptable behavior and usage of the Service.

5. Payment and Billing
All payments made by Credit Card or Pre-Authorized Debit (“forms of payment”) are subject to a 2.4% payment processing fee. As these are the only forms of payment accepted by FibreTel, a 2.4% fee will be added to the total of your monthly bill. If we do not receive payment of an amount due on your account by the specified required payment date, your account will be charged a missed payment fee of $25 (e.g. once per month that a payment is not made by the due date), and the account will be subject to an account interest charge of 3% per month on the outstanding balance. This account interest charge will accrue on a daily basis and will be calculated and compounded monthly on the outstanding amount (42.58% per year) from the date of the first bill on which it appears until the date we receive that amount in full. You agree that we can charge any unpaid and outstanding amount, including any account interest charge, missed payment, or transaction processing fee charges, on any pre-authorized payment method on your account (e.g., a credit card or bank account withdrawal).

6. Privacy
Your privacy is important to us. Please refer to our Privacy Policy for information on how we collect, use, and disclose personal information.

7. Equipment
You are responsible for providing and maintaining all equipment necessary to access the Service. All equipment provided by FibreTel must be returned when your service is canceled. Lost, damaged, or unrecoverable equipment will be billed to your account at the actual replacement value for new or comparable equipment.

8. Intellectual Property
All intellectual property rights related to the Service, including trademarks, copyrights, and proprietary information, belong to FibreTel.

9. Limitation of Liability
FibreTel is not liable for any damages arising from the use or inability to use the Service, including but not limited to, direct, indirect, incidental, punitive, and consequential damages. Subscriber acknowledges that FibreTel does not warrant uninterrupted or error free Services, or the content, availability, accuracy or any other aspect of any information including all data, files and all other information or content in any form, accessible or made available to or by the Subscriber or any other persons using the Subscriber’s Service.

10. Service Interruption
You acknowledges that FibreTel may interrupt the Services from time to time to perform maintenance or repairs on the Services.

11. Termination
We reserve the right to terminate or suspend your access to the Service at any time without prior notice for any reason. If the termination of the service is requested by the customer, FibreTel will send a technician to uninstall the service at it’s expense and the date this work is completed will be the service termination date.

12. Subscriber Obligations
As a subscriber to FibreTel’s Service, you agree to the following obligations:

a. You are responsible for all persons you authorize or grant access to use FibreTel’s Service. Any actions or omissions of these authorized users will be considered your own.

b. You agree to provide FibreTel with reasonable access to your location for performing necessary maintenance or repairs to ensure the continued quality of service.

c. You shall not tamper with or make changes to the Services as provided by FibreTel or any equipment provided by FibreTel. Any unauthorized modifications may result in termination of service.

13. Access for Services
You authorize us and our representatives to enter or have access to your premises as necessary at mutually agreed upon times to install, maintain, inspect, repair, remove, replace, investigate, protect, modify, upgrade or improve the operation of our services, the Equipment or our facilities or networks. If any of your Services or accounts have been cancelled, then you authorize us and our representatives to enter or have access to your premises to disconnect the Services and remove our Equipment, as applicable.

14. Network Management
We reserve the right to manage our networks in order to optimize their efficiency for the benefit of our subscribers, including, without limitation,
by way of the following: rate limiting (speed), rejection or removal of spam or otherwise unsolicited bulk e-mail, anti-virus mechanisms, dns filtering, and protocol filtering. We may take any other action we deem appropriate in order to help ensure the integrity of the network experience for all subscribers. For details on our network management practices, visit

15. Change of Services
When downgrading internet service, equipment may need to be replaced and you will continue to be billed at the current service level until such date as the equipment replacement can be completed. Access to your home may be required to make these changes. If you only cancel a phone service, television service, or television service add-on, applicable charges continue to apply until your next billing date for that add-on.

16. Phone Services
In order for 9-1-1 emergency services to function properly with Phone Services, you must use the Equipment we have provided (“Equipment”) at your service address in it’s originally installation configuration. We will not be liable to you or to any third party for your failure to comply with this requirement.

The Phone Services may not function correctly, or at all, in the following circumstances:

a. if the Equipment or other hardware fails or is not configured correctly;
b. in the event of a network outage or power failure;
c. if you tamper with or move the Equipment to a location other than your service address
d. if there are deficiencies with the inside wiring within your home; or
e. following suspension or cancellation of your Services or account.

We will not be liable to you or to any third party for any inability to use the home phone Services or to obtain access to 9-1-1 emergency services as a result of the limitations described in this Section.

14. Changes to Terms
We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the province where the services are installed, without regard to its conflict of law provisions.
